15-Year Legal Battle Ends as Exxon Faces $14.25M Fine Over Baytown Violations

A 15-year legal battle over air pollution in Baytown has come to a close, with the U.S. Supreme Court declining to hear ExxonMobil’s appeal of a $14.25 million penalty. The decision leaves intact a ruling from the U.S. 5th Circuit Court of Appeals, which upheld the fine for more than 16,000 violations of the Clean Air Act at Exxon’s Baytown petrochemical complex between 2005 and 2013.

The penalty, now confirmed as final, is the largest ever issued in a citizen-initiated Clean Air Act lawsuit. It follows a long legal campaign by environmental groups Environment Texas and the Sierra Club, who filed suit in 2010 on behalf of residents living near the massive refinery. Those residents reported ongoing exposure to pollutants, including carcinogens and ozone-forming chemicals.

Initially, a federal judge in Houston imposed a $19.95 million fine in 2017 after a trial in which affected residents testified about health and quality-of-life impacts. That amount was later reduced on appeal to $14.25 million, but ExxonMobil continued to challenge the ruling, arguing that the environmental groups lacked legal standing to sue.

By denying Exxon’s appeal without comment, the Supreme Court effectively affirmed the lower court's conclusion that citizen groups do have the right to take legal action when facing the effects of industrial pollution—even when financial penalties go to the federal government rather than the plaintiffs themselves.

ExxonMobil has not issued a public response to the decision. Legal experts and environmental advocates say the ruling sets a key precedent in support of community-led environmental enforcement.

Baytown Man Dies in SH 146
Crash Near Moss Hill

A Baytown man lost his life in a single-vehicle crash Saturday afternoon, June 28, along State Highway 146 north of Moss Hill.

Authorities identified the victim as 56-year-old Jason Bryan Chesser. The accident occurred around 3:30 p.m. as Chesser was traveling southbound in a 2014 Nissan Rogue. According to investigators with the Texas Department of Public Safety, the vehicle veered off the roadway for reasons not yet determined and collided with a large tree.

There were no signs that Chesser attempted to brake before the impact, leading officials to suspect that a medical emergency may have occurred prior to the crash. After striking the tree, the vehicle began to spin and overturned, coming to rest upside down in a ditch on the east side of the highway. Chesser was partially ejected from the vehicle and died at the scene.
