Baytown Mother Sues Police for Wrongful Charges After Son’s Fatal Crash

A Baytown mother has filed a lawsuit against the city’s police department, claiming she was wrongfully prosecuted following a devastating 2020 car crash that killed her five-year-old son and left multiple people critically injured.

Heather Guerra filed the suit in Harris County District Court on Friday, alleging malicious prosecution, civil rights violations, and emotional harm after facing criminal charges related to the fatal crash. Guerra had been charged with manslaughter and aggravated assault in the aftermath of the July 8, 2020 collision at the intersection of Decker Drive and West Baker Road.

The crash, which occurred while Guerra was driving with her son and a friend, left her in a coma and critically injured others. Her son, Julian Guerra, was pronounced dead at the scene. After she regained consciousness, Guerra was arrested and charged in connection with the incident. She spent nearly three years fighting the allegations before prosecutors dismissed both charges in May 2023, citing insufficient evidence.

According to the lawsuit, Guerra claims that Baytown Police Officer Robert B. Parker falsified details in a warrant affidavit, alleging she smelled of alcohol at the scene. Medical records reportedly indicated no alcohol was present in her system. The suit further alleges that another officer, Angel Puga, conspired with Parker to press charges despite lacking probable cause, and that body camera footage from the scene was later reported missing. A third officer, Mark Street, is accused of failing to conduct a proper investigation.

Guerra is seeking over $1 million in damages for emotional distress, lost wages, legal costs, and limitations imposed while under bond.

The Baytown Police Department has acknowledged the lawsuit but declined further comment, stating the matter is under active litigation.

Floor Mat Mishap Ends in Crash

This is just one example of the variety of calls that police officers respond to throughout their shift. Their day is anything but predictable.

Around 10:30 a.m., BPD officers on the A-side day shift were dispatched to the 500 block of W. Baker Rd. after a vehicle crashed into a building. When they arrived, officers found a Toyota Corolla had crashed through the glass wall of a vacant bank building. The 62-year-old driver told officers her floormat got caught underneath the brake pedal, causing her to accidentally press the gas instead of the brake.

Thankfully, no one was injured.

🚨 PSA: A simple floormat check could stop a crash before it starts. It only takes a moment for something unexpected to happen.

Annual Free Fishing Day! 🎣

Join us any time between 9 am - noon to learn some tips and try your hand at catching a big one! A fishing license is not required to fish in any public water on THIS DAY ONLY, but all other state fishing regulations apply. 

Learn about fish anatomy by crafting a fish print, see a fish scale up close under a microscope, and practice your casting with Backyard Bass.
